The petition filed by Sheikh Roshan Mohiddi has also alleged arbitrariness in awarding grace/compensation marks to students.

The petitioners have claimed in the petition that they are working for the welfare of the students. The plea said that the high marks of 718 and 719 out of 720 by many students is ‘statistically impossible’. The plea said that the daily awarding of supplementary marks by the National Testing Agency due to the delay during the examination is a malicious attempt to give backdoor entry to some students. The petition alleged that 67 students from a single examination center scored 720 out of 720 marks, which strengthens the suspicion that the result was not fair. The petition said that there are many complaints regarding the final answer key released by the National Testing Agency on April 29. The petition said that citing widespread complaints of leaking question papers of the examination conducted on May 5, the result has been canceled and the examination conducted afresh.

In the present petition, it is stated that two petitions seeking cancellation of the examination on the basis of paper leak have already been filed in the Supreme Court. It also said that on May 17, the Supreme Court had issued notices to the National Testing Agency and others in the matter and sought their response, however, it refused to stay the declaration of results.

Besides, another petition filed in the Supreme Court has challenged the National Testing Agency’s decision to award grace/compensatory marks to students in the National Entrance Cum Eligibility Test. Jaripet Karthik, a student appearing for NEET has filed this application. By filing a petition directly in the Supreme Court under Article 32 of the Constitution, the NTA has challenged the decision to grant grace marks to 1563 students. This mark was awarded to students whose examination started late at the examination centre. Meanwhile, Advocate Y. appearing on behalf of the applicant. Balaji and Chirag Sharma have approached the Supreme Court registry and sought an early hearing on the petition.

The petition stated that the use of normalization formula by NTA for awarding grace marks is not only wrong but also illegal, arbitrary and violative of Articles 14 and 21 of the Constitution of India. The petition also said that the normalization formula cannot be applied in the present case as the purpose of the examination is to ascertain the knowledge of the subject, but the formula gives marks not on the basis of certainty but on the assumption of knowledge.

The petition also states that if the normalization formula is possible, it can be extended to the number of questions that can be left unanswered in proportion to the loss of time, since each question has equal weightage, hence, equal time distribution can be assumed to answer each question. . The petition said that since the examination was conducted in offline mode, there was no standard to accurately measure the loss of time. It also stated that no assessment or report has been released by the authorities to justify the grant of Grace Point in case of alleged loss of time. The petition said that the NTA has not placed any evaluation report, opinion or CCTV footage in the public domain which would clarify that the late start of the examination led to loss of time in awarding grace marks to 1563 students.
