What does the Motor Vehicle Act say?

In fact, there is a separate section in the Motor Vehicles Act for minor offenders. In which it is clearly written that in such cases parents or vehicle owners will be held guilty. In such a case, he will be jailed for up to three years. Apart from this, a fine of Rs 25,000 will also be imposed. This provision was included in the Motor Vehicle Act in view of the increasing cases of underage driving. It says, if the parent, guardian or owner can prove that the offense was committed without their knowledge. or he cannot be held guilty of such offense only if he has taken all reasonable steps to prevent such offence. The law mentions that the court hearing such cases will presume that the minor used the vehicle with the consent of the guardian or owner.

The child has an accident, you will be punished

According to the Motor Vehicles Act, the registration of vehicles used by minors involved in any accident or crime will also be canceled for one year. There are ample provisions in the Act, whereby the owner of a motor vehicle will be liable for providing the vehicle to a person who does not have a valid driving license.

“If a vehicle meets with an accident, the liability should automatically be on the owner, who has allowed the minor to drive the vehicle,” says road safety expert Rohit Baluja.

Shilpa Mitta, sister of Siddharth Sharma, who ran over a minor with a speeding Mercedes in Delhi eight years ago, says that in such cases many people are involved in the crime, including parents or guardians, officials. He said, “We have been fighting my brother’s case for the last eight years and there has been no effective trial yet because most of the rich people feel that they can buy everything with money.
