Advocate Prashant Patil has given a statement on behalf of Shilpa Shetty and Raj Kundra. The complainant filed a criminal complaint against my clients Raj Kundra and Shilpa Shetty in the year 2022. The complaint was thoroughly investigated by the police in the year 2022 with due process of law. After investigation, it was revealed that the complainant had actually paid the alleged Rs. The alleged amount of 90 lakhs was obtained through legitimate payment. My clients honestly handed over these documents to the police department. After knowing the truth of the case, the police gave justice to my clients. After this enquiry, the complainant chose to file a private complaint under Section 156(3) of CrPC before the Hon’ble Court.
After almost 2 years, the Namdar court has ordered the police to re-investigate the case. We have full confidence in the independence and impartiality of the investigation. Truth will prevail. My clients have not committed any crime and this is proved by the documents available with my clients. The invoice between the complainant and my client clearly shows that the above agreement contains an arbitration clause.
If the complainant has any grievance regarding the alleged “amount of interest”, the arbitration clause can certainly be invoked. However, the practice of initiating criminal proceedings for settlement of commercial disputes has been condemned by several judgments of the Hon’ble Supreme Court and various Hon’ble High Courts of our country. My client will fight this battle legally and cooperate with the investigating agencies. My clients reserve their right to sue the prosecutor for malicious prosecution at the appropriate stage of the proceedings.
