Handcuffs should not be used for economic offenders: Parliamentary Committee

Report of the Committee on Proposed Legislation Indian Judicial Code (BNS-2023), Indian Civil Protection Code (BNSS-2023) and Indian Evidence Act (BSA-2023). The three bills, introduced in the Lok Sabha on August 11, will replace the Indian Penal Code, 1860, the Code of Criminal Procedure and the Indian Evidence Act, 1872, if they become law. The committee’s report was handed over to Rajya Sabha Speaker Jagdeep Dhankhar last Friday.

According to a parliamentary committee, it appears that the use of handcuffs should be limited to selected heinous crimes to prevent escape of accused of serious crimes and to ensure safety of police officers and personnel during arrest. However, the Committee is of the view that economic crimes should not be included in this category. “This is because the term ‘economic crimes’ covers a wide range of crimes,” it said in its report. Handcuffing may not be appropriate in all cases falling under this category.” The Committee said, “Therefore, the Committee recommends that Article 43(3) may be suitably amended to delete the words ‘economic offence’. .”

This is stated in Section 43(3) of the BNSS regarding the use of handcuffs.

Section 43(3) of the BNSS states, “Police officers may, having regard to the nature and gravity of the offence, use handcuffs while arresting any person who is a habitual criminal and who has escaped from custody or has committed an organized crime, terrorist Crime of act, drug related offense or crime of illegal possession of arms and ammunition, murder, rape, acid attack, forgery of currency notes, human trafficking, sexual offenses against children, committed acts or economic crimes threatening India’s sovereignty, unity and integrity.
