The Delhi High Court has said that the income proof for admission to a Kendriya Vidyalaya (KV) in the Economically Weaker Section (EWS) category should be issued by the appropriate authority and not by the state government where the school is located. The High Court also held that the KVS cannot refuse admission to a student in the EWS category on the ground that the income certificate has been obtained from a state other than the Delhi government.

Justice Anup Jairam Bhambhani said that the Central Government has instructed that after careful verification of all relevant documents and following due process laid down by the concerned State Governments, a certificate for this purpose will be issued by an officer at least at the level of Tehsildar. in the state. should be issued by The High Court said, “This means that a candidate applying for admission to a KV school anywhere in the country under the EWS category need not produce a certificate issued by the State Government where the school is situated, but such a certificate is required. shall be prepared by an officer of the specified rank in the State where such verification is possible.”


It said that the central government has notified an annual family income limit which is less than eight lakh rupees for the purpose of determining the EWS category.


The high court said, ‘The basis on which the KVS has rejected the admission of the applicant’s child, i.e. the EWS certificate obtained from the state of Uttar Pradesh and not from the Delhi government, is unacceptable.’


The High Court accepted the petition of a person seeking a direction to the KVS (Delhi Pradesh) to admit his son to a Kendriya Vidyalaya in the national capital under the EWS category. On January 3, 2022, the letter issued by the authorities denying them entry was rescinded.


The applicant, a native of Azamgarh in Uttar Pradesh, initially sought first class admission for his son in the EWS category. He said he had come to Delhi for a job and wanted his son to get admission in Kendriya Vidyalaya in the national capital. As a lot of time was wasted during the litigation, the court ordered that he be admitted to class III.


He was given an EWS certificate by the Tehsildar of Azamgarh.
