Night shelters cannot be operated permanently in public parks: Delhi High Court

The Delhi High Court on Thursday said that night shelters in public parks cannot be functional on a permanent basis. The High Court asked the Municipal Corporation of Delhi (MCD) to seek permission from the Delhi Urban Shelter Improvement Board (DUSIB) to ensure proper functioning of Urdu. Park near Jama Masjid. Ask to vacate the occupied space. A bench headed by Acting Chief Justice Manmohan said night shelters in public parks could only be ‘temporary’, otherwise the entire green area would be destroyed.

The bench told MCD’s counsel, “Tell them that you have given it for a limited time. Tell them they need to find an alternate location. (They) cannot occupy public parks. Write them to clear the night shelter. “Tell them you need green space.” Justice Mini Pushkarna is also on the bench. The High Court was hearing a plea by Mohammad Arsalan regarding encroachment in public parks around the Jama Masjid in Old Delhi. The court has fixed further hearing of this matter on April 10.
