The Allahabad High Court has sought an affidavit within 24 hours from the secretary of the Basic Education Council, Prayagraj, regarding non-compliance with the order to award one mark in the recruitment of 69,000 assistant teachers. The court has asked him why he is not complying with the order. Prima facie this is contempt of court. The court has allowed Basic Education Council Secretary Pratap Singh Baghel to be made a party and ordered to file the petition on November 23. Justice Rohit Ranjan Aggarwal passed the order on the contempt petition of Upendra Kumar Dayal and others.

Petitioner’s lawyers Anurag Tripathi and Rahul Mishra submitted to the Principal Secretary Basic Education Dr. MKS sought permission from the court to make Sundaram a party. The court accepted it. The government said that a special appeal is pending in the Lucknow bench in this matter. The hearing should be adjourned until the appeal is decided. Advocate Anurag Tripathi objected to this. Said that the government has not filed a special appeal.

There is an appeal by the candidate and no interim order has been passed thereon. The Supreme Court has also ordered the appointment of the successful candidates in the result by giving wrong question number, which is not followed. At the last hearing, the court sought an affidavit from the Secretary Examination Regulatory Authority regarding the compliance of the order within 48 hours but the affidavit was not produced.
